Marijuana in the Workplace

Marijuana may be the most commonly used illegal drug in the United States. The disparity between many state law and federal laws regarding the legal use of marijuana, also known as cannabis, is often a source of confusion for employers and employees alike. While marijuana remains a federally classified Schedule I drug, many state laws allow the use of medical or even recreational marijuana. Medical marijuana employment law is an emerging, ever-changing topic that employers learn to navigate carefully.

In this upcoming webinar, we will uncover what rights employers have regarding drug testing and the enforcement of drug-free workplace policies when federal and state employment laws collide.

The webinar will address:
• Medical marijuana and the Americans with Disabilities Act (including the interactive process and reasonable accommodations);
• The impact of recreational marijuana on the workplace;
• Best practices for drug-free workplace policies
• Drug testing laws impacting the workplace
• Criminal background checks
• FMLA and substance abuse
• The Drug-Free Workplace Act of 1988
• Department of Transportation regulations and substance abuse
• OSHA regulations and substance abuse
• Unemployment Insurance and substance abuse
• Your liability as an HR professional

With over half of the United States providing for some form of legal use of marijuana, determining whether to discharge an employee for a positive marijuana drug test or accommodate the worker under the ADA can be a tough call. Join us and learn about recent legal developments that will help you build policies and procedures in your organization.
